NEW DELHI: Fearing that the Eknath Shinde faction will take over Shiv Sena properties and bank accounts after the Election Commission declared it to be the real Shiv Sena and allotted the ‘bow and arrow’ symbol, the Thackeray group on Tuesday convinced the Supreme Court for an urgent hearing on Wednesday afternoon for a stay on the EC order.
The Thackeray group, through senior advocate Kapil Sibal, told a bench headed by CJI D Y Chandrachud that unless the “erroneous EC order is stayed forthwith, the Shinde faction will take over everything, including the assets of Shiv Sena and its bank accounts. They have already taken over the Sena political party office in the assembly”.
Understanding the urgency, the CJI said, “We will disrupt the Constitution bench hearing on Wednesday afternoon and give you 30 minutes to argue your case a t 3 . 30pm. ” When Sibal insisted for a hearing on Tuesday itself, the CJI said, “We would like to read the petition. ” The Shinde faction, which has filed a caveat to preempt any ex parte order from the SC, through senior advocate N K Kaul, said the p etitioners should be asked to move the Bombay HC where they had gone twice during the pendency of the issue before the EC. He said the SC had also earlier refused to stay the EC exercise on the Thackeray faction’s plea.
