NEW DELHI: The Supreme Court on Saturday stayed all proceedings before single-judge and division bench of Calcutta HC in a matter relating to caste certificate scam, which saw unsavoury judge vs judges sparring.
In a special hearing, a five-judge bench comprising CJI DY Chandrachud and justices Sanjiv Khanna, BR Gavai, Surya Kant, and Aniruddha Bose issued notice to the West Bengal government and the original petitioner in the case.
The top court also issued notice to CBI, to whom HC single-judge bench had handed over the probe which in turn was stayed by division bench leading to judge vs judge unpleasantries.
“We will take this up on Monday, took this up now to pass this order. We have taken charge now,” the bench said.
The West Bengal government told the Supreme Court that it is filing an appeal against the single-judge bench Avijit Gangopadhyay’s order directing CBI probe into the certificate scam.
The apex court ordered that Bengal’s appeal too should be placed for hearing on Monday.
Solicitor general Tushar Mehta told the Supreme Court that the HC division bench’s order appeared to be without jurisdiction as the stay order was passed by it without an appeal memo, which was impermissible as per an earlier SC judgment.
